UCLA doctor sentenced for sex crimes has conviction tossed because one of the California jurors didn't speak English

California is beyond parody.

 

A former gynecologist at UCLA hospital was previously convicted for being a sex predator and was handed down an 11 year sentence for his crimes.

 

But that conviction was just tossed for THE most California reason possible:

He will now have the opportunity for a new trial.

I'm not a trial lawyer, but I think one of my questions for a potential juror might be something like, "Do you speak English?".

Especially in California!

A three-justice panel from California's 2nd District Court of Appeal ruled Dr. James Heaps was denied a fair trial because the judge did not share with his defense counsel a note by the court's foreman pointing out concerns that one juror lacked sufficient English to carry out their duties.

 

Heaps' attorney, Leonard Levine, said he and his team were not aware of the note or that there was any question about a juror's ability to serve until two years later when an attorney working on an appeal discovered it in a court file.

How stupid is this judge?

 

The foreman told the judge, "Hey, one of these jurors doesn't really speak English" and instead of addressing it then and there the judge did nothing? And didn't even tell the defense?

 

I mean, I don't want to speak in favor of accused sex offenders, but receiving a trial in this joke of a legal system is so not fair.

 

In the 31-page ruling, the appellate court panel pointed out that within about one hour of Juror No. 15 being seated as a substitute for a juror who had a medical issue, concerns were raised about whether the person was qualified to serve. The foreman's note indicated that Juror No. 15 did not speak English well enough to participate in the deliberations, the ruling stated.

 

The amount of incompetence here is staggering.
